Preamble


Welcome to HesabPay.

HesabPay is an Electronic Money Institution (EMI) licensed and supervised by Da Afghanistan Bank (“DAB”), the central bank of the Islamic Emarat of Afghanistan. HesabPay provides a secure digital wallet and a wide range of payment, transfer, and bill-payment services to individuals, businesses, government entities, and international partners.
By downloading the HesabPay mobile application, creating an account on our website, dialing the USSD short-code *580# from a feature phone, or otherwise accessing any HesabPay service you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions of use together with our Privacy Policy and any product-specific terms referenced herein.
If you do not agree to any part of these Terms and Conditions (“Agreement”), you must not register for, access, or use the Services.
HesabPay reserves the right to amend these Terms and Conditions of Use (“Agreement”) from time to time to reflect changes in applicable laws, regulations, or service offerings. The most current version will always be available on the HesabPay website (www.hesab.com) and on the HesabPay mobile application.


1. Definitions
For the purposes of this Agreement, the following capitalized terms shall have the meanings set forth below:

•    HesabPay: we, us, or our refers to HesabPay LLC, an Electronic Money Institution licensed by Da Afghanistan Bank.
•    Customer: User, or You refers to any individual or legal entity that registers for, holds, or uses a HesabPay account.

•    Account: means the electronic wallet account opened in the Customer’s name on the HesabPay platform.
•    DAB: means Da Afghanistan Bank, the central bank of Afghanistan and the primary regulatory authority of HesabPay.
•    KYC: means Know-Your-Customer identity verification procedures.
•    CDD and EDD: mean Customer Due Diligence and Enhanced Due Diligence respectively.
•    AML/CFT: means Anti-Money Laundering and Combating the Financing of Terrorism.
•    FIU: means the Financial Intelligence Unit of Afghanistan (FinTRACA).
•    MNO: means a Mobile Network Operator (e.g., Roshan, MTN, Etisalat, AWCC, Salaam).
•    OTP: means a one-time password, a temporary code used to verify a user during login or transaction for security purposes.
•    PIN: means a Personal Identification Number, a secret code used to authorize and process transactions.
•    Agreement: means these Terms and Conditions of Use, as may be amended from time to time.
•    Privacy Policy: means the policy governing the collection, use, and protection of user data.
•    Services: means all products, features, and channels provided by HesabPay, as described in Section 5 of this Agreement.
•    Third-Party Service Providers: means external companies, vendors, processors, billers, and partners that help provide or support specific            Services, as described in Sections 5 and 12 of this Agreement.


2. Customer Identification Requirements (KYC / CDD)
In compliance with DAB AML/CFT regulations and applicable Afghan law, every Customer must complete identity verification before Conducting transaction beyond the basic-tier limits. HesabPay reserves the right to request, verify, and re-verify identification information at any time during the customer lifecycle.

2.1 For Individual Customers

•    Full legal name (as it appears on the official identity document)
•    Father’s name
•    Date of birth
•    Nationality
•    A live (real-time) photograph of a valid identification document, such as a paper Tazkira, e-Tazkira, or passport.
•    Live photo / selfie verification (biometric liveness check)
•    Active mobile telephone number
•    Email address (where available)
•    Residential address (province, district, village, street)
•    Occupation and source of income 

2.2 For Business / Corporate Customers

•    Valid business license (AISA, ACBR, or relevant licensing authority)
•    Tax Identification Number (TIN) and tax registration certificate
•    Articles of incorporation and/or partnership deed
•    Ultimate beneficial owner (UBO) information for all owners holding ≥ 10%
•    Board resolution authorizing the opening of a HesabPay account
•    List of authorized signatories with specimen signatures and identity documents
•    Registered business address and operating premises
•    Detailed description of the nature of business
•    Source of funds and expected transaction profile

Failure to provide, or providing false, misleading, or incomplete information may result in immediate rejection of the application, suspension or closure of an existing Account, freezing of funds, and/or reporting to the appropriate authorities.


3. AML/CFT, Customer Due Diligence and Sanctions Screening

3.1 Customer Due Diligence (CDD)
HesabPay reserves the right to:

•    Verify the identity of every Customer using reliable identification documents and independent data sources;
•    Conduct ongoing risk-based assessments and assign each Account a risk rating (low, medium, high);
•    Request additional documentation or clarification at any point in the relationship;
•    Conduct Enhanced Due Diligence (EDD) on high-risk customers, politically exposed people (PEPs), or unusual transaction patterns;
•    Continuously monitor transactions for indicators of money laundering, terrorist financing, fraud, or sanctions evasion.

3.2 Sanctions and PEP Screening
All Customers are screened, both at onboarding and on an ongoing basis, against the following watchlists. Customers appearing on any of these lists may be denied service, subjected to permanent enhanced monitoring, or have their relationship terminated:

•    United Nations Security Council Consolidated Sanctions List
•    U.S. Office of Foreign Assets Control (OFAC) Specially Designated Nationals (SDN) List
•    Da Afghanistan Bank domestic watchlist and FIU notifications
•    European Union and UK HM Treasury sanctions list (as applicable)
•    Politically Exposed Persons (PEP) databases (domestic and foreign)
•    Adverse media and negative news screening sources

3.3 Suspicious Activity Reporting
The Customer expressly acknowledges and agrees that:

•    Any transaction or pattern of transactions that HesabPay reasonably suspects to be linked to money laundering, terrorism financing, fraud, sanctions evasion, or any other unlawful activity will be reported to FinTRACA, Da Afghanistan Bank, and/or other competent authorities, without prior notice to the Customer;
•    HesabPay may freeze, hold, restrict, or close an Account at any time and for as long as necessary to comply with its legal and regulatory obligations;
•    HesabPay is legally prohibited from “tipping off” the Customer regarding any internal investigation or the filling of Suspicious Activity Report (SAR).

4. Account Usage — Permitted and Prohibited Activities

4.1 Permitted Activities

•    Cash-in and cash-out at authorized HesabPay agents, partner banks, or kiosks;
•    Person-to-person (P2P) money transfers, both domestic and across borders, were permitted by law.
•    Mobile airtime top-ups to all Afghan Mobile Network Operators (Roshan, ATOMA, Etisalat, AWCC, Salaam) and selected international operators;
•    Payment of electricity, water, internet, and other bills available on the platform.
•    Hotel bookings and the purchase of flight and bus tickets through HesabPay’s integrated travel partners;
•    Payment to merchants using QR code, NFC, payment links, and in-app checkout;
•    Access to HesabPay services through the USSD code (*580#) on feature phones.
•    Receipt and distribution of salaries, pensions, humanitarian aid, and government payments.
•    Card issuance, top-up, and management services provided through HesabPay's Visa partnership (See Section 5.8),
•    Any other service expressly enabled by HesabPay from time to time and communicated to the Customer.

4.2 Prohibited Activities
Customers must not use the Account, directly or indirectly, for any of the following purposes:

•    Money laundering or the layering of illicit proceeds;
•    Financing of terrorism or support to terrorist organizations.
•    Fraud, identity theft, account takeover, or social engineering against any person or entity
•    Gambling or betting activities that are prohibited under Afghan law;
•    Trade in narcotics, weapons, human trafficking, or other illegal goods or services;
•    Sanctions evasion or transactions with sanctioned individuals, entities, or jurisdictions;
•    Operating unlicensed money-service businesses, hawala, or third-party payments processing using a personal Account;
•    Any form of deception, misrepresentation, or impersonation;
•    Any activity that violates Da Afghanistan Bank (DAB) regulations, or this Agreement.

5. Description of HesabPay Services
HesabPay offers an integrated suite of digital financial services through its mobile application, web portal, USSD (*580#) channel, agent network, and APIs. The following subsections describe the principal Services and the third-party integrations that enable them. The Customer acknowledges that certain Services rely on third-party providers and, by using such Services, expressly consents to the limited sharing of personal data as described in Section 12.

5.1 Electronic Wallet
Every registered Customer is provided with a HesabPay electronic wallet denominated in Afghani (AFN) and, where applicable, supported foreign currencies. The wallet enables the storage of value, sending and receiving money, making payments, and accessing all other Services. Access is secured through device binding, biometric authentication (where supported), a numeric PIN, and one-time passwords (OTPs) delivered via SMS or in-app push notifications. 5.2 Mobile Top-Ups
HesabPay is directly integrated with all licensed Afghan Mobile Network Operators (Roshan, ATOMA Afghanistan, Etisalat, Afghan Wireless (AWCC), and Salaam Network) to provide real-time airtime, data, and bundle top-ups. To process a top-up, the recipient mobile number is transmitted to the relevant MNO solely to credit the requested airtime; no other personal data is shared for advertising or marketing purposes.

5.3 Electricity Bill Payments
Customers may pay their electricity bills issued by Da Afghanistan Breshna Sherkat (DABS) directly through the HesabPay app or USSD. To validate the bill and process the payment, the Customer’s DABS account number (and where required, name and meter ID) is shared with DABS solely for the purpose of bill verification and settlement.

5.4 Bus Ticket Bookings
Through partnerships with licensed inter-city bus operators in Afghanistan, HesabPay enables Customers to search routes, reserve seats, and purchase bus tickets. To complete a booking, the passenger’s full name, identification number (where required by the carrier), travel date, and route are shared with the relevant bus operator solely For the purpose of issuing and honoring the ticket.

5.5 Hotel Bookings
HesabPay integrates with domestic and international hotel inventory partners to allow Customers to search, book, and pay for hotel stays. The guest’s name, contact information, check-in and check-out dates, and payment confirmation are shared to the hotel or aggregator solely For the purpose of completing the reservation and provide on-site service.

5.6 Flight Tickets Booking
HesabPay is integrated with airline reservation systems and travel aggregators to enable the purchase of domestic and international air tickets. To issue a ticket, passenger details such as full name, date of birth, passport or Tazkira number, gender, nationality, and contact details are shared with the airline, the Global Distribution System (GDS), and any required regulatory authority (e.g., advance passenger information) solely for the purpose of ticket issuance, check-in, and Compliance with applicable air travel requirements

5.7 Money Transfer and Wallet Funding
Customers may fund their HesabPay wallet through authorized agents, partner bank transfers, card top-ups (Visa/Mastercard), and international remittance partners. Customers may transfer money to other HesabPay users, bank accounts, or mobile wallets on interoperable networks. Sender and recipient information, including (name, phone number, account number, and transaction reference) are processed as required to complete the transaction and comply with applicable regulatory requirements and Da Afghanistan Bank (DAB) regulations.

5.8 Card Issuance and Visa Integration
HesabPay has integrated with Visa to issue physical and virtual payment cards linked to the HesabPay wallet (the “Visa Integration”). For the avoidance of doubt, this integration is limited to card issuance and related services. HesabPay does not act as a card-acquiring processor under this arrangement. Cardholders are subject to this Agreement, as well as the applicable Visa rules and cardholder terms.

5.9 Other Third-Party Integrations
To deliver a secure, global, and feature-rich experience, HesabPay also integrates with the following third-party service providers. Each integration is contractually bound by data-protection clauses requiring the partner to use shared data solely for the purpose of providing the relevant service to the Customer, and never for independent advertising or unrelated commercial purposes:


•    Stripe — international card processing and acceptance for cross-border merchant transactions;
•    Plaid — secure bank-account verification, account linking, and balance/transaction data retrieval for funding and payouts;
•    Visa — card issuance, BIN sponsorship, and cardholder authentication services (for card issuance only, see Section 5.8);
•    Mobile Network Operators (Roshan, MTN, Etisalat, AWCC, Salaam) airtime, data, and bundle top-ups;
•    Da Afghanistan Breshna Sherkat (DABS) — electricity bill presentment and settlement;
•    Licensed bus operators — inter-city ticket inventory and seat reservation;
•    Hotel aggregators and individual hotels — room inventory, booking, and payment;
•    Airline GDS / aggregator partners — flight inventory and ticket issuance;
•    SMS gateways and push-notification providers — OTP and transaction alerts;
•    Identity verification / KYC vendors — document authentication and biometric liveness;
•    Cloud infrastructure and cybersecurity vendors — hosting, monitoring, and fraud prevention;
•    Additional integrations may be added from time to time and will be disclosed in updates to this Agreement.

6. Authentication, Security, and Electronic Wallet Access
Access to the HesabPay Account is secured through a layered authentication model that combines:

•    Mobile application or web portal login bound to the Customer’s registered device(s);
•    One-Time Passwords (OTP) delivered via SMS, push notification, or in-app generator;
•    A numeric Personal Identification Number (PIN) chosen by the Customer;
•    Biometric authentication (fingerprint or face) where supported by the Customer’s device;
•    Risk-based, step-up authentication for high-value or unusual transactions.

The Customer is solely responsible for safeguarding all credentials, including the PIN, OTP, and any device used to access HesabPay. The Customer must never share these credentials with any third party, including persons claiming to be HesabPay staff. HesabPay will never request a Customer’s PIN or full OTP.

7. Transaction Limits
HesabPay applies daily, monthly, and per-transaction limits in accordance with the EMI and AML/CFT regulations issued by Da Afghanistan Bank. Limits vary by Account tier (Basic, Standard, Premium, Corporate) and KYC level. Limits may be temporarily reduced or increased based on risk monitoring, regulatory directives, or commercial considerations. Current limits are available in the HesabPay app and on the website and may be updated from time to time.

8. Fees and Charges
The following standard fee structure applies. Detailed and product-specific fees are published in the in-app fee schedule and on www.hesab.com:

Visa card issuance / replacement As per published Visa card pricing schedule
Foreign-exchange conversion (where applicable) HesabPay’s prevailing FX rate, including spread, displayed before confirmation
HesabPay reserves the right to amend the fee schedule by giving notice through the app, SMS, email, or its website. Continued use of the Services after such notice constitutes acceptance of the revised fees.


9. Customer Obligations
The Customer agrees, at all times, to:

  • •    Provide accurate, complete, and truthful information onboarding and during ongoing CDD;
    •    Promptly update HesabPay of any change in personal, contact, business, or KYC information;
    •    Maintain the confidentiality of the Account, PIN, OTP, biometric data, and registered device;
    •    Use the Services only for lawful purposes and in accordance with this Agreement;
    •    Verify the recipient details before confirming any transfer or payment (HesabPay is not liable for transactions executed correctly bases on         Customer-provided details);
    •    Report any suspected unauthorized access, lost device, or fraudulent transaction immediately by calling the HesabPay support center,                contacting the in-app support, or visiting an authorized branch.


10. HesabPay Rights and Authority
HesabPay reserves the right, at its sole discretion and to the extent permitted by law and regulation, to:

  • •    Reject any account application without giving reasons;
    •    Suspend, restrict, or impose limits on any Account;
    •    Freeze funds in the Account where required by law, court order, regulatory directive, or where HesabPay has reasonable grounds to                    suspect fraud, AML/CFT violations, or other unlawful activity;
    •    Close an Account, with or without prior notice, where the Customer breaches this Agreement, fails to maintain valid KYC, or where                     required by law or by Da Afghanistan Bank;
    •    Request updated identification, source-of-funds, or source-of-wealth documentation;
    •    Reverse, decline, or hold any transaction that appears to be erroneous, duplicate, fraudulent, or non-compliant.


11. Data Protection and Privacy

11.1 Consent to Data Collection and Processing
By accepting this Agreement, the Customer consents to the collection, storage, processing, and (where applicable) transfer of personal data by HesabPay for the purposes of providing the Services, meeting regulatory obligations, preventing fraud and financial crime, and improving the platform.


11.2 Categories of Data Collected

  • •    Identity data: full name, father’s name, date of birth, nationality, Tazkira/passport number, photograph, biometric template;
    •    Contact data: mobile number, email, residential and business address;
    •    Financial data: wallet balance, transaction history, beneficiary information, linked bank accounts, card details (stored in PCI-DSS compliant         tokenized form);
    •    Device and technical data: device ID, IP address, operating system, app version, geolocation (where consented), and log files;
    •    Behavioral data: in-app activity, support interactions, and risk scoring signals.

11.3 Purposes of Processing

  • •    Customer onboarding, KYC, and ongoing CDD;
    •    Execution and settlement of transactions;
    •    Regulatory reporting to DAB, FIU, tax authorities, and other competent bodies;
    •    Fraud monitoring, security, and incident response;
    •    Customer support, dispute resolution, and complaints handling;
    •    Service improvement, product analytics, and (only with separate opt-in) marketing communications.


12. Data Sharing With Third Parties
HesabPay shares the minimum necessary Customer data with selected third parties strictly to deliver the Services the Customer has requested or to comply with legal obligations. HesabPay does not sell, rent, or trade Customer data to advertisers, data brokers, or any other party for marketing or behavioral-advertising purposes.

12.1 Categories of Recipients

  • •    Regulators and authorities: Da Afghanistan Bank, FinTRACA, tax authorities, courts, and law-enforcement agencies, when required by law;
    •    Settlement and clearing partners: domestic and international banks, switch operators, and card networks (e.g., Visa);
    •    Issuance and processing partners: Visa (issuance), Stripe (international card acceptance), Plaid (bank-account verification);
    •    Service-delivery partners: MNOs (top-ups), DABS (electricity bills), bus operators (ticketing), hotel partners (bookings), airlines and GDS             (flight tickets);
    •    Operational vendors: cloud infrastructure providers, KYC verification vendors, SMS/email gateways, fraud-prevention and cybersecurity              providers;
    •    Professional advisors: auditors, legal counsel, and compliance consultants, under strict confidentiality.

12.2 Important Statement on Purpose Limitation
Where personal data is shared with a third party in order to deliver a Service (for example, sharing a passenger’s name and passport number with an airline to issue a flight ticket, or sharing an account number with DABS to pay an electricity bill), that data is shared solely for the purpose of processing the requested transaction and not for advertising or any unrelated commercial purpose. All third parties are contractually required to handle Customer data in accordance with applicable data-protection laws and the security standards required by HesabPay.

12.3 Cross-Border Transfers
Some third-party providers (such as Visa, Stripe, Plaid, cloud infrastructure vendors, and international airline systems) process data outside Afghanistan. By using the Services, the Customer consents to such cross-border transfers, which are governed by appropriate contractual safeguards and the privacy policies of the respective providers, including:

13. Data Storage, Retention, and Security

13.1 Where and How Data Is Stored
Customer data is stored in secure, access-controlled data centers operated by HesabPay and its contracted cloud providers. Production data is encrypted at rest using AES-256 (or equivalent) and in transit using TLS 1.2 or higher. Card data is never stored on HesabPay systems in plaintext; it is tokenized in accordance with PCI-DSS requirements.

13.2 Retention Period
HesabPay retains Customer identification records and transaction data for a minimum of five (5) years following the end of the customer relationship or the date of the transaction, in accordance with DAB AML/CFT regulations. Certain records may be retained for longer periods where required by law, regulatory directive, ongoing investigation, or to defend or pursue legal claims.

13.3 Cybersecurity Measures

  • •    Multi-layered network security including firewalls, intrusion-detection / prevention systems, and DDoS protection;
    •    Role-based access control with least-privilege principles and multi-factor authentication for staff;
    •    24/7 security monitoring and a documented incident-response plan;
    •    Regular vulnerability assessments, penetration testing, and independent security audits;
    •    Secure software development lifecycle (SSDLC) practices and code review;
    •    Business continuity and disaster recovery plans tested at least annually.

13.4 Customer’s Right to Access and Correction
Subject to identity verification, the Customer has the right to access the personal data HesabPay holds about them, request correction of inaccurate data, and, where legally permissible, request deletion. Requests should be submitted through the in-app support center or by writing to [email protected]. Some requests cannot be fulfilled where the data must be retained for regulatory or legal purposes.


14. Governing Law and Regulatory Framework
This Agreement and the Services are governed by, and shall be construed in accordance with, the laws of the Islamic Emarat of Afghanistan. The primary regulatory framework includes, without limitation:

  • •    Da Afghanistan Bank AML/CFT Regulations;
    •    Da Afghanistan Bank Electronic Money Institution (EMI) Regulation;
    •    Electronic Payment and Electronic Money Regulations issued by DAB;
    •    Applicable consumer protection rules for financial services in Afghanistan.
    •    Anti-Money Laundering and Proceeds of Crime Law of Afghanistan.
    •    Combating Financing of Terrorism Law of Afghanistan;
    •    Any other law, regulation, or directive issued by competent Afghan authorities.

The competent courts of Kabul, Afghanistan shall have exclusive jurisdiction over any dispute arising out of or in connection with this Agreement, without prejudice to any mandatory regulatory or arbitration procedure described in Section 17.


15. Notices and Customer Communication
HesabPay may communicate with the Customer through any of the following channels, each of which is deemed a valid and binding form of notice:

  • •    SMS messages to the registered mobile number;
    •    Email notifications to the registered email address;
    •    In-app push notifications and electronic statements;
    •    Telephone calls and WhatsApp messages from official HesabPay numbers;
    •    Announcements posted in the HesabPay mobile application or on www.hesab.com;
    •    Any other official communication channel disclosed by HesabPay from time to time.

The Customer is responsible for keeping their contact details current and for regularly reviewing communications received from HesabPay.


16. Limitation of Liability and Risk
To the maximum extent permitted by applicable law, HesabPay shall not be liable for any loss, damage, cost, or expense arising from or in connection with:

  • •    Failures, interruptions, or degradations of telecommunications networks, internet connectivity, electricity supply, or any other infrastructure outside HesabPay’s direct control;
    •    Force majeure events including natural disasters, war, civil unrest, pandemic, regulatory shutdowns, or government directives;
    •    Outages, errors, or omissions of third-party service providers (including but not limited to Visa, Stripe, Plaid, MNOs, DABS, bus operators, airlines, hotels, and aggregators);
    •    Customer negligence, including disclosure of PIN/OTP, loss or theft of device, use of compromised devices or networks, or failure to update KYC information;
    •    Delays or refusals to process transactions where such delay or refusal is required to comply with this Agreement, applicable law, regulatory directives, or risk-management policies;
    •    Indirect, incidental, special, consequential, or punitive damages, including loss of profits, goodwill, or business opportunities.

17. Complaints and Dispute Resolution
HesabPay is committed to handling complaints fairly, promptly, and transparently. Customers may raise a complaint through any of the following channels:

  • •    In-app “Support chat” section;
    •    HesabPay call center 580 
    •    Email to [email protected] or [email protected].
    •    Customers may visit any HesabPay branch to register complaints.

Standard resolution timelines:

  • •    Acknowledgement of complaint: within 2 business days;
    •    Resolution of routine complaints: within 7 business days;
    •    Resolution of complex or investigation-bound complaints: within 30 business days;
    •    Escalation to Da Afghanistan Bank: where the Customer is not satisfied with the resolution, they may escalate the matter to the DAB                 Consumer Protection Unit in accordance with DAB procedures.

Where the parties are unable to resolve a dispute amicably, the dispute may be referred to mediation or arbitration in Kabul under Afghan law, or to the competent courts as set out in Section 14.


18. Account Closure and Dormancy
An Account that has no Customer-initiated activity (login or transaction) for a continuous period of six (6) months will be flagged as inactive. Without prejudice to any earlier action HesabPay may take under this Agreement, the Account will then be reclassified to dormant status, and the relevant Afghan Government and DAB dormant-account policies will be applied, including any required notifications, fee treatment, and transfer of unclaimed balances to designated authorities after the prescribed period.
Customers may reactivate a dormant Account by completing identity re-verification, settling any applicable fees, and submitting any updated KYC information requested by HesabPay.


19. Amendments to These Terms and Conditions
HesabPay may amend this Agreement at any time to reflect changes in applicable law, regulatory requirements, business operations, or Service offerings. Material changes will be communicated to the Customer through SMS, email, in-app notification, or by posting on www.hesab.com at least fifteen (15) days before the effective date, where reasonably practicable. Continued use of the Services after the effective date of any amendment constitutes acceptance of the amended Agreement.


20. Customer Declaration and Consent
By accepting this Agreement, the Customer expressly declares and confirms that:

  • •    All information provided to HesabPay is true, accurate, complete, and up to date;
    •    The Customer has read, understood, and accepted this Agreement, including the fee schedule, data-sharing arrangements, and risk                    disclosures;
    •    The Customer consents to AML/CFT screening, sanctions screening, ongoing transaction monitoring, and the sharing of data with                      regulators and third parties as described in this Agreement;
    •    The Customer understands the risks associated with electronic money services, including risks of fraud, phishing, device compromise, and         network outages, and agrees to take reasonable precautions;
    •    The Customer is entering into this Agreement freely, voluntarily, and with full legal capacity, and (in the case of a business Customer) has         all necessary corporate authorizations.
